:This course will examine the legal, constitutional, and practical considerations in investigation, prosecution, and defense of hate crimes under section 319(1) and (2) as well as regular Criminal Code offences such as criminal harassment and mischief. For example, one of the constitutional issues that will be explored is whether “protest”, by commission of offences such as mischief, is constitutionally protected and what consideration that ought to receive in the decision to charge, resolve, or sentence the person. In addition to lectures, and focused discussions, this course will include police, defense and Crown guest speakers with relevant expertise.
